Terms of Service

These terms govern your use of Aardvark’s website, browser extension, and related services.

1. Introduction

Welcome to Aardvark, a service operated by Aardvark Holdings Inc. (“Aardvark,” “we,” “our,” or “us”). These Terms of Service (“Terms”) form a legally binding agreement between you and Aardvark Holdings Inc., a Delaware corporation, governing your use of Aardvark’s website, browser extension, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use Aardvark.

2. What Aardvark Provides

Aardvark is a platform that connects shoppers with deals shared by creators and brands. Shoppers can discover and redeem deals, while creators can upload and promote offers to their audiences. We may update or modify features at any time to improve your experience or ensure compliance with legal and business requirements.

3. Eligibility & Account Responsibilities

  • You must be at least 13 years old (or 16 where required by law) to use Aardvark.
  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate information and keep it up to date.
  • You agree not to share your account or allow unauthorized access.

4. Creator Accounts vs. Shopper Accounts

If you are a Creator, you may upload deals, connect affiliate programs, and manage your membership plan. If you are a Shopper, you can browse and redeem deals. Both account types are subject to these Terms unless otherwise specified.

5. Subscriptions & Payments

  • Creators may choose a paid subscription plan, billed via our secure payment provider (Stripe).
  • Subscriptions automatically renew unless canceled before the next billing cycle.
  • All fees are non-refundable except where required by law.
  • Aardvark does not handle payment information directly. All transactions are processed securely by third-party providers.

6. Acceptable Use Policy

You agree NOT to:

  • Use Aardvark for illegal or fraudulent activities.
  • Upload malicious content, spam, or deceptive deals.
  • Attempt to hack, disrupt, or reverse-engineer the platform.
  • Infringe on any intellectual property rights.

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Intellectual Property

All Aardvark software, logos, designs, and branding are owned by Aardvark Holdings Inc. and protected by law. By uploading content (e.g., deals, brand logos, affiliate links), you grant Aardvark a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content for the purpose of operating and improving the Service.

8. Third-Party Links & Integrations

Aardvark may link to third-party websites or services (e.g., brands, affiliate programs). We are not responsible for their content, terms, or privacy practices. You should review third-party policies before interacting with them.

9. Privacy & Data Use

Your use of Aardvark is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Termination

You can delete your account at any time in Account Settings. We may suspend or terminate accounts that violate these Terms or disrupt the platform. Upon termination, your right to access Aardvark ends immediately. Some data may be retained as required by law.

11. Disclaimers & Limitation of Liability

Aardvark provides the Service “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Aardvark disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event will Aardvark be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to your use of the Service. Deals are provided by creators or brands, and Aardvark is not responsible for the accuracy, availability, or quality of third-party offers.

12. Indemnification

You agree to indemnify and hold harmless Aardvark Holdings Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Service.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any disputes will be resolved through binding arbitration in Chicago, Illinois, unless otherwise required by applicable law. You and Aardvark waive any right to a jury trial or to participate in a class action, to the maximum extent permitted by law.

14. Changes to These Terms

We may update these Terms periodically. If we make significant changes, we will notify you via email or in-app alerts. Continued use of Aardvark after updates means you accept the revised Terms.
